These Terms of Use ("Terms") govern your access to and use of the OpExCore platform ("Platform", "Service"), operated by OpExCore ("we", "us", "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
OpExCore is a multi-tenant Software-as-a-Service (SaaS) platform for operational excellence, continuous improvement, and lean management. The Platform is provided to organisations ("Tenants") and their authorised users ("Users").
Access to the Platform requires a user account created by your organisation's administrator. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify your administrator immediately if you become aware of any unauthorised use of your account.
We reserve the right to suspend or terminate access to any account that violates these Terms, is inactive for an extended period, or poses a security risk to the Platform.
Your data belongs to you. All content, ideas, actions, projects, reports, and other data entered into OpExCore by your organisation remains the intellectual property of your organisation at all times.
We do not claim ownership of any data you or your users submit to the Platform. Your organisation retains all rights, title, and interest in its data. We will not sell, share, license, or distribute your data to any third party, except as strictly necessary to provide the Service (for example, hosting infrastructure) or as required by law.
You grant us a limited licence to store, process, and display your data solely for the purpose of operating the Platform and providing the Service to your organisation. This licence terminates when your account is closed and your data is deleted.
OpExCore offers optional AI-powered features as premium add-ons, including AI Executive Reports, AI Action Plan Generation, and AI-assisted suggestions within lean tools. These features are powered by the Anthropic Claude API, a third-party artificial intelligence service.
When you use an AI feature, the Platform sends relevant data from your tenant (such as ideas, actions, KPIs, or the content of a lean tool analysis) to the Anthropic API to generate a response. The data sent is limited to what is needed for that specific request — we do not send your entire database.
OpExCore uses the Anthropic commercial API. Under Anthropic's commercial API terms, your data is never used to train AI models. This is a flat policy — there is no opt-in or opt-out, it simply does not happen.
Specifically, under the Anthropic commercial API terms:
AI-generated content (reports, action plans, suggestions) is provided as a starting point to assist your team. It should be reviewed, edited, and validated by your users before being acted upon. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content. Your organisation remains responsible for all decisions made using the Platform.
AI features are premium add-ons controlled by your organisation's super administrator. They can be enabled or disabled per tenant at any time. The core Platform — ideas, actions, projects, KPIs, lean tools, and reports — functions fully without AI features enabled. No data is sent to external AI services unless an AI feature is actively triggered by a user.
We take the security of your data seriously. The Platform is hosted on dedicated infrastructure within the United Kingdom and employs industry-standard security measures including:
While we implement appropriate technical and organisational measures to protect your data, no system is completely secure. You are responsible for ensuring your users follow good security practices, including using strong passwords and not sharing login credentials.
OpExCore is a multi-tenant platform, meaning multiple organisations share the same application infrastructure. All data is logically segregated by tenant. Every database query is scoped to your organisation's unique tenant identifier, ensuring no user can access data belonging to another organisation.
You agree not to use the Platform to:
Access to the Platform is provided on a subscription basis. Pricing, billing cycles, and included features are as agreed between your organisation and OpExCore. We reserve the right to update pricing with reasonable notice. Free trial periods, where offered, are subject to the same Terms.
We aim to provide a reliable service but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our control. We will endeavour to provide advance notice of planned maintenance where possible.
Your organisation's data is retained for the duration of your active subscription. Upon termination or cancellation of your account, we will retain your data for a period of 30 days to allow for reactivation or data export. After this period, all data associated with your tenant will be permanently deleted from our systems.
You may request a full export of your data at any time during your subscription by contacting your administrator or our support team.
To the maximum extent permitted by law, OpExCore shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the Platform. Our total liability for any claim arising from or relating to these Terms or the Service shall not exceed the amount paid by your organisation in the 12 months preceding the claim.
We may update these Terms from time to time. Where changes are material, we will notify tenant administrators via email or an in-platform notification at least 14 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
